The petitioners apprehend their arrest in connection with Majhauliya Police Station Case No.224 of 2015 registered under Sections 302 and 201/34 of the Indian Penal Code, pending in the court of the Chief Judicial Magistrate, Bettiah, West Champaran. The allegation of the informant Saiful Khatoon is that when her elder son saw his wife Maimul Nisa in an objectionable position with Mahmood Ansari, he abused and assaulted his wife.

No.50732 of 2015 (3) dt.07-12-2015 2/2 Thereafter, Maimu Nisa went to her Maika and retuned with all the six F.I.R. named accused persons, who were variously armed with, and all of them abused her and returned back. When her daughter-in-law came to her house yesterday, his elder son abused and assaulter her and, thereafter, her daughter-in-law went to her Maika and she came with all the F.I.R. named accused persons with different weapons who dragged his son causing assault and carried him away. The dead body of her elder son was, later on, found in the field of Ali.
Learned counsel appearing on behalf of the petitioners submits that, in fact, the deceased died due to consuming poison. Having considered the facts and the circumstances of the case and the nature of allegation against the petitioners, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, the prayer of the petitioners for grant of anticipatory bail stands rejected. However, the petitioners are directed to surrender before the trial court within four weeks from today and pray for regular bail, which shall be considered by the trial court on its own merit without being prejudiced by the order of this Court.
