The petitioner seeks bail in a case instituted under Sections 147, 148, 149, 341, 323, 337, 332, 333, 353, 427, 156, 295(A) and 295 of the Indian Penal Code.

The prosecution story, in brief, is that during peace march in which the District Magistrate, Superintendent of Police and other persons were also accompanying, 500-700 miscreants armed with bamboos, bricks and stones attacked upon the members of the peace march, in which, 47 persons including the petitioner was identified and arrested.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 13.10.2016. The petitioner has got

Patna High Court Cr.Misc. No.51083 of 2016 (2) dt.28-11-2016 2/2 no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. No specific allegation has been made against the petitioner. General and omnibus allegation has been made against the petitioner. The other coaccused has been granted bail vide Cr. Misc. No. 50877 of 2016. On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Udakishunganj, Madhepura in connection with Bihariganj P.S. Case No. 173 of 2016.
