JUSTICE MADHURESH PRASAD ORAL ORDER 12-12-2017 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This is a case registered for the offence punishable under Sections 395, 397, 353, 307, 323, 342, 332, 333, 336, 337, 338, 427, 504, 114, 115, 186, 144, 145, 146, 147, 148 and 149 of the Indian Penal Code and Section 27 of the Arms Act.
The allegation has been made in the First Information Report against 132 named accused persons alleging brick-batting and by doing so obstructing
Patna High Court Cr.Misc. No.55636 of 2017 (2) dt.12-12-2017 2/3 the officials from measuring the acquired land. The petitioner is not even named in the aforesaid list of 132 accused persons.
It has been submitted on behalf of the petitioner that he has no criminal antecedent prior to the instant case and the allegations are general and omnibus. The petitioner is student and has been arrested merely on the ground of suspicion. He is in custody since 23.09.2017 in connection with the instant case. Learned Counsel for the petitioner has submitted that amongst 132 named accused persons, some have been granted bail in other cases.
Considering the aforesaid submissions, the prayer for bail of the petitioner is allowed. Let the petitioner, above named, be released on bail on his furnishing bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Patna, in connection with Digha P.S. Case No. 282 of 2017, subject to the conditions:
(i) That one of the bailors will be a close relative of the petitioner, who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.
