The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 379/411 of the IPC.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He has been falsely implicated in this case. There is no recovery from the conscious possession of the petitioner and no TIP and petitioner is not named in FIR. On the confessional statement, co-accused petitioner made accused in this case.

In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender

Patna High Court CR. MISC. No.73637 of 2019(2) dt.21-11-2019 2/2 before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Lakhisarai in connection with Birpur P.S. Case No.35/2019, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, subject to surrender before the learned lower court.
