The petitioners apprehend their arrest in Karakat P.S. Case No. 69 of 2021, registered for the offence punishable under Sections 30(a)(c), 33, 36 and 38 of the Bihar Prohibition and Excise Act, 2018.

2000 litres of spirit has been recovered from a pick-up van.

It is submitted that nothing has been recovered from conscious possession of this petitioner. Petitioner is neither driver nor owner of vehicle in question and has got no concern with the seized spirit.

Patna High Court CR. MISC. No.65438 of 2022(3) dt.22-12-2022 2/2 Counsel for the State vehemently opposed the bail application and submitted that petitioner has got one criminal antecedent of similar nature.

Considering the fact that petitioner is having criminal antecedent of similar nature, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected (Prabhat Kumar Singh, J) vinita/- U T
