NILU AGRAWAL ORAL ORDER 20-12-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner is languishing in judicial custody since 22.07.2016 in connection with Sangrampur P.S. Case No. 73 of 2016 registered for the offence punishable under Section 392 of the Indian Penal Code.

The prosecution case is that while the petitioner was returning home on his motorcycle, four miscreants on gun point snatched his motorcycle.

It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and has falsely been implicated on the confessional statement of one Sonu Kumar. It has further been submitted that nothing incriminating

Patna High Court Cr.Misc. No.52854 of 2016 (2) dt.20-12-2016 2/2 has been seized from his possession and no Test Identification Parade has been done so far and that co-accused Sonu Kumar has since been granted the privilege of bail by this Court in Cr.Misc.No.52377 of 2016 on 16.12.2016 and other co-accused Mannu Kumar Chaudhur @ Manu Kumar Chaudhur has also been granted the privilege of bail by this Court in Cr.Misc.No.51079 of 2016 on 28.11.2016.

However, learned A.P.P. for the State opposes the prayer for bail.

Considering the facts and circumstances, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Motihari, East Champaran in connection with Sangrampur P.S.
