KUMAR ORAL ORDER 12-06-2020 The proceedings of the Court are being conducted through Video Conferencing and the Advocates joined the proceedings through Video Conferencing from their residence. Heard learned counsel for the petitioner, learned counsel for the Union of India and learned counsel for the State. Petitioner, who is in custody, seeks bail in a case registered for the offences punishable under Sections 20 (b)(ii) (c) and 29 of the Narcotics Drugs and Psychotropic Substances Act.
Allegation against the petitioner as per the FIR is recovery of 137 Kg. of Ganja from the Bolero vehicle and the petitioner was arrested along with the other co-accused.
Patna High Court CR. MISC. No.79898 of 2019(4) dt.12-06-2020 2/2 Petitioner has earlier moved this Court for bail vide Cr. Misc. No. 54298 of 2018 which was rejected on 21.12.2018. It has been submitted on behalf of the petitioner that he is innocent and has falsely implicated in this case. He has no concern with alleged contraband substance and the said vehicle. Petitioner has got no criminal antecedent and is in custody since 06.03.2018.
Report was called for with respect to stage of trial and it is stated in report send by trial court that 2 witnesses out of 8 witnesses have been examined.
As there is recovery of 137 Kg. of Ganja from the vehicle in which petitioner was also one of the four occupants, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is rejected. However, trial court is directed to expedite and conclude the trial within one year from the date of receipt/production of copy of order passed by this Court. (S. Kumar, J) veena/rajiv U T
