2. The petitioner is in custody in connection with Bodh Gaya (Cherki) P.S Case No. 520 of 2022 registered for the offences punishable under Sections 395 of I.P.C.
3. The prosecution case in short is that the informant with his staff going on a motorcycle, in the meantime 8 persons on three motorcycles came and dashed the informant's motorcycle and on the point of pistol the miscreants snatched cash of Rs. 30,000, gold of 20 gm and two ATM cards and also assaulted the informant. Thereafter the miscreants fled away from there.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.74516 of 2024(2) dt.31-01-2025 2/2 petitioner has falsely been implicated in this case. It is further submitted that petitioner is not named in FIR. It is further submitted that no articles have been recovered from the conscious possession of the petitioner. It is also submitted that petitioner is in judicial custody since 22.04.2024. It is also submitted that co-accused has also granted bail in Cr. Misc. No. 75922 of 2023.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.
6. Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gaya in connection with Bodh Gaya (Cherki) P.S Case No. 520 of 2022.
