JUSTICE ADITYA KUMAR TRIVEDI 23-02-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

There happens to be an allegation against the petitioner and others levelled at the end of informant Nishant Kumar that having variously armed, they came at his shop where on an order of Randhir, Murari gave rod blow over his leg. Hira, Awnish, Aashish began to assault him with lathi, fist and slap. His maternal uncle Shailesh intervened who was assaulted by Randhir, petitioner over his head. Then thereafter, Kunal took Rs.1,25,000/-, Randhir Kumar Singh Samsung mobile set. Though charge sheet has been submitted under Section 341,323,307,504,506 IPC but from the case diary, it is evident that doctor who had examined both the injured namely, informant as well as Shailesh Singh had reserved opinion relating to injury no.

1 in respect of both the injured being identified as 11⁄2" x 1" swelling was visible on knee of left leg, relating to Nishant and 1"1/3" skin deep lacerated wound on head relating to Shailesh for that C.T. Scan was advised which not been produced till then. The other injury having over person of both the injured has been found simple in nature. Apart from the aforesaid event, it is also apparent that both the parties are uncle and nephew and they are loggerhead over partition. Petitioner happens to be under custody since 17.10.2016.

Patna High Court Cr.Misc. No.52432 of 2016 (3) dt.23-02-2017 Accordingly, petitioner Randhir Kumar Singh @ Randhir Singh is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned S.D.J.M, Udakishunganj (Madhepura) in connection with Alam Nagar P.S.
