JUSTICE SUDHIR SINGH ORAL ORDER 10-02-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 363, 366A and 34 of the Indian Penal Code.

Allegation against the petitioner is that he enticed away the daughter of the complainant for the purpose of marriage or to sell her.

It is submitted on behalf of the petitioner that he has got no criminal antecedent. The alleged occurrence is said to have taken place on 7.7.2009 but the complaint case was filed on 3.5.2010 and the F.I.R. has been instituted on 23.9.2010. No explanation has been made in respect to the delay in filing the complaint. It is further submitted that petitioner had married the victim girl and there is a child also out of the said wedlock. On behalf of the State, it is submitted that petitioner is named in the F.I.R. and the victim girl is traceless till date. Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner, same is rejected.

Any how, the petitioner is directed to surrender in the

Patna High Court Cr.Misc. No.50967 of 2015 (4) dt.10-02-2016 2/2 court below, i.e., C.J.M., Saran, in connection with Parsa P. S. Case no. 91 of 2010 within a period of six weeks from the date of receipt of a copy of this order and pray for regular bail which shall be considered and disposed of on its own merit without being prejudiced by this order.
