The petitioner is languishing in custody in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case as per F.I.R is that on 07.08.2018, the accused persons came to the house of the informant and took his son with them towards east direction. After one house, the informant received

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is not named in the F.I.R and his name subsequently sprang up only on the basis of suspicion during the investigation. There is no eye witness to the occurrence. Moreover, other similarly situated co-accused has been granted bail vide order dated 14.12.2020 passed in Cr. Misc. No. 33582 of 2020. The petitioner is languishing in custody since 07.06.2023.

In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st
