The petitioner seeks bail in a case registered under Sections 341, 323, 324, 325, 307/34 of the Indian Penal Code. The prosecution case in short is that in the trivial issue, an altercation took place between the parties and in consequence thereof, the accused persons including the petitioner assaulted the informant and his father with Farsa, Lathi & Danda. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 07-08-2019. Charge sheet has already been submitted. The petitioner has been falsely implicated in the present case. There is case and counter case

Patna High Court CR. MISC. No.62377 of 2019(3) dt.19-11-2019 2/2 between the parties. The injury on the side of the accused has not been explained by the prosecution. The prosecution has not come with clean hands.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran in connection with Marhaura (Gaura O.P.) P.S. Case No. 333 of 2018.
