JUSTICE MADHURESH PRASAD ORAL ORDER 19-12-2017 Heard learned counsel for the petitioner and the CBI. The petitioner, who was a branch manager in the Punjab National Bank, has been made accused in a disproportionate asset case under sections 13(1)(e) read with 13(2) of the PC Act, 1988.

Petitioner is in custody since 20.8.2017. His submission is that the prosecution has made under assessment of the salary, added the assets of his unmarried daughters and Stridhan of his wife and thus it has presented a false finding with respect to his assets to the tune of Rs.24 lacs. Charge sheet has also been submitted in the case and the petitioner undertakes to regularly appear in the court below to facilitate expeditious disposal of the trial. Petitioner is in custody since 14.9.2017 having no antecedent.

The prayer for bail of the petitioner is allowed and the petitioner as mentioned above is directed be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Special judge, CBI, 1st Patna in Special case no. 07 of 2014, RC case no. 23A of 2014

Patna High Court Cr.Misc. No.56435 of 2017 (3) dt.19-12-2017 on the following conditions:- (a) One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with him. The bailor will also undertake to inform the court if there is any change in the address of the petitioner. (b) The petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
