NILU AGRAWAL ORAL ORDER 23-12-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner is languishing in judicial custody since 06.09.2016 in connection with Uchkagaon P.S. Case No. 190/16 registered for the offences punishable under Sections 376, 511 of the Indian Penal Code.

The prosecution case, as lodged by the informant, is that while she was watching television in her house at 10.00 P.M. in the night the petitioner came there and tried to outrage her modesty, but on the alarm being raised, the petitioner fled away. It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and has committed no offence. It is submitted that there was a money

Patna High Court Cr.Misc. No.54683 of 2016 (2) dt.23-12-2016 2/2 dispute between the parties and the informant had called him to take back the money and implicated him in a false case. It is further submitted that the petitioner was in medical treatment during the alleged period.

However, learned A.P.P. for the State submits that the petitioner is named in the First Information Report, hence, opposes the prayer for bail.

Be that as it may, considering the facts and circumstances and the submission of the parties and since petitioner has no criminal history, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate-IX, Gopalganj in connection with Uchakagaon P.S. Case No. 190/16. (Nilu Agrawal, J.) Rajesh/- U T
