The petitioner has prayed for bail in a case registered for the offence punishable under sections 406 and 420 of the Indian Penal Code.

As per allegation in the FIR, petitioner has loaded short cash in different ATMs and thereby cheated the company. It is further alleged that petitioner was the custodian of cash and usurped money by loading short cash.

It is submitted by learned counsel for the petitioner that Petitioner has been falsely implicated in this case. There is delay of 87 days in lodging the FIR. Petitioner was terminated from the service by the company before the alleged date of occurrence. Entire allegation is bases on suspicion. Similarly

Patna High Court CR. MISC. No.65252 of 2022(2) dt.25-02-2023 2/2 situated other co-accused person has already been granted regular bail vide order dated 22.02.2023 passed in Cr. Misc. No. 64787 of 2022 by different co-ordinate Bench of this Court. Petitioner has no criminal antecedent and he is languishing in judicial custody since 5.09.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJMXV, Gopalganj in connection with Mirganj P.S. Case No. 141 of 2022.
