2. The petitioner has preferred this application for grant of regular bail in connection with Sangrampur P.S. Case No. 195/2024 dated 31.07.2024 registered for the offences punishable under Sections 126(2), 115(2), 118(1), 132, 221 read with Section 3(5) of the B.N.S. 2023 and Sections 3(1)(r), 3(1) (s) and 3 (2)(Va) of the SC/ ST Act and Section 37 of the Bihar Prohibition and Excise (Amendment) Act, 2022.
3. As per the prosecution case, the informant received information that one Vinod Mahto was stabbed by the petitioner and others. Thereafter, the informant along with other police officials reached Ramna Tola, where the petitioner and the co-

No.66192 of 2025(2) dt.09-10-2025 2/3 accused persons along with 15-20 unknown accused persons surrounded the police party and abused the informant by calling caste name and assaulted the police personnel with lathi bricks and stones causing injury. Thereafter, police apprehended two co-accused persons who disclosed their names as Vijay Sah and Sanjay Sah. When the Breathalyzer Test was done, the coaccused Vijay Sah was tested positive for consuming alcohol.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Learned counsel has submitted that the injuries are simple in nature. There is general and omnibus allegation against the petitioner. Nothing has been recovered from the possession of the petitioner. The petitioner was not apprehended on the spot. His name has come in the present case because the petitioner happens to be the relative of the apprehended co-accused persons Vijay Sah and Sanjay Sah. It is further submitted that the other co-accused persons, namely, Vijay Kumar @ Vijay Sah and Sanjay Sah have already been granted bail by a Bench of this Court in Cr. Misc. No. 70285 of 2024 vide order dated 01.10.2024, annexed as Annexure-P/2 to the present bail petition. The petitioner has three criminal antecedents in which he is on bail as stated in para 3 of the bail petition. The
Patna High Court CR. MISC. No.66192 of 2025(2) dt.09-10-2025 3/3 petitioner is in custody since 08.04.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. -1, East Champaran, Motihari, in connection with Sangrampur P.S. Case No. 195/2024.
7. The application stands allowed.
