JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-10-2019 This is an application for grant of anticipatory bail in connection with Kadamkuan P. S. Case No. 380 of 2018, disclosing offences under Sections 384, 387, 448, 34 of IPC. As per F.I.R. crores of rupees has been given to Md. Naushad Alam of A.V.M. Developers and the informant is the Managing Director of Bakarganj A.V.M. Developers, Pvt. Ltd. Further allegation is that informant was called by Md. Naushad Alam and he was threaten to withdraw the case lodged against him and thereafter, petitioner and other accused persons were moving around the house of the informant and also threaten the informant on the point of revolver.

Submission of the learned counsel for the petitioner is

Patna High Court CR. MISC. No.66243 of 2019(2) dt.22-10-2019 2/2 that only on suspicion, he has been accused in this case and the dispute is between one Sacchidanand Singh.

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that petitioner is named in the F.I.R. as the henchman of Md. Naushad Alam and they have threatening the complainant and he is accused in four other cases also.

Having heard both sides, in view of the allegation and antecedents, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail.
