2. The petitioner seeks regular bail in connection with Haspura P.S. Case No. 32 of 2024 for the offences registered under Sections 363/ 366 of the Indian Penal Code.
3. As per the prosecution case, on 09.02.2024 daughter of the informant had gone for Coaching to Haspura, but she did not return. In spite of search, she could not be traced out. It is alleged that at about 10 P.M. informant received a call from a lady that her husband has taken away his daughter and his name is Santosh Kumar (petitioner).
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. The victim has not made any allegation against the
Patna High Court CR. MISC. No.67531 of 2024(4) dt.16-12-2024 2/2 petitioner. She has stated in her statement that she herself had gone with the petitioner. Petitioner has not kidnapped the victim. Petitioner has no criminal antecedent. He is in judicial custody since 11.03.2024. Charge-sheet has already been submitted in this case. Petitioner undertakes to co-operate in the trial. Learned counsel further submits that due to misunderstanding the case has been filed, however, both parties have compromised.
5. Learned counsel for the informant conceded that both parties have compromised.
6. Considering the submissions made on behalf of the parties and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Daudnagar, Aurangabad in connection with Haspura P.S.
