JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-12-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323, 354, 376, 448, 506/34 of the Indian Penal Code. The prosecution case is that petitioner being relative of the informant entered into the house of the informant and ravished her. On protest being made the accused persons took away the petitioner from the house of the informant.

It is submitted by learned counsel for the petitioner that on conclusion of the investigation the final form/charge-sheet has been submitted under Sections 341, 323, 354, 506/34 of the Indian Penal Code and consequently the cognizance has also been taken under the said provisions of the Indian Penal Code.

Considering the fact that offence under

Patna High Court Cr.Misc. No.56299 of 2015 (2) dt.16-12-2015 2/2 Section 376 I.P.C has not been found true, it is a case for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Sheikhpura Mahila P.S. Case No. 63 of 2013, pending in the Court of learned Judicial Magistrate, 1st Class, Sheikhpura. With the observations above, the application stands disposed off.
