JUSTICE SATYAVRAT VERMA ORAL ORDER 04-03-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State through the virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Sections 30(a), 41(1) and 41(2) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is in custody since 20.07.2022.

The petitioner is alleged to have been arrested on the ground that 150 litres of liquor was found in his hut. Learned counsel for the petitioner submits that the hut does not belong to the petitioner and he has been falsely implicated in the present case.

Patna High Court CR. MISC. No.694 of 2023(2) dt.04-03-2023 2/2 Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the submission of the learned counsel for the petitioner, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.1,000/- (Rupees One Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Special Case No. 11383 of 2019, PR. No. 277 dated 20.12.2019.
