2. The petitioner is in custody since 17.08.2023 in connection with Phulwariya P.S. Case No. 293/2023 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 69.600 litres of country made liquor has been recovered the car.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case due to enmity. He further submits that the petitioner is the driver of the vehicle from which recovery has been made and he has no knowledge about the consignment. Petitioner has no criminal antecedent.

5. Considering the facts and circumstances of the case, let the petitioner above named be released on bail, on

Patna High Court CR. MISC. No.66711 of 2023(2) dt.16-10-2023 2/2 furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge II cum Special Judge, Excise Court No. 1, Gopalganj in connection with Phulwariya P.S. Case No. 293/2023.
