1. Heard learned counsel for the parties.

2. The petitioner has renewed his prayer for grant of regular bail in connection with Sessions Trial no.98 of 2025, Murliganj P.S. Case no.200 of 2023, registered under sections 302, 341, 386, 120B, 504 and 506 of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, the informant states that on the orders of Sunil Verma, on the firing resorted to by Anil Yadav, Bauaa Yadav and Nitish Kumar, her husband sustained gunshot injuries and fell to the ground. It is further stated that thereafter the petitioner and one Vijay Kumar also fired upon the informant's husband. He died thereafter.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.64890 of 2025(2) dt.19-09-2025 2/3 earlier application for bail of the petitioner was rejected vide order dated 24.1.2025 passed in Cr. Misc. no.85666 of 2024 giving liberty to the petitioner to renew his prayer for bail after six months or on framing of charge, whichever is later. It is submitted that it has been more than 6 months since the said order of rejection and referring to the order of the learned Court below it is submitted that charge has been framed against the petitioner in the learned trial Court on 4.6.2025. It is submitted that the petitioner be enlarged on bail and he undertakes to cooperate in the trial.

5. Learned counsel for the informant files his vakalatnama in Court today which is taken on record.

6. The application for bail is opposed by learned A.P.P. for the State and learned counsel for the informant. Opposing the application for bail it is submitted by learned counsel for the informant that as a result of firing resorted to by several accused persons, the husband of the informant sustained injuries and fell to the ground. Thereafter the petitioner and one another also fired at the informant's husband as a result of which he subsequently died.

7. Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in

No.64890 of 2025(2) dt.19-09-2025 3/3 the F.I.R., the liberty granted in the earlier order of rejection dated 24.1.2025, the petitioner having remained in custody since 26.2.2024 and charge having been framed in the learned trial Court, the petitioner is directed to be enlarged on bail in connection with Sessions Trial no.98 of 2025, Murliganj P.S. Case no.200 of 2023, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Additional Sessions Judge-IV, Madhepura.
