====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 14-11-2019 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek bail in a case for the offence registered under Section 392 of the IPC.

The prosecution story, in brief, is that on 16.07.2019 at about 3.15 P.M. while the informant alongwith Chaturbhuj Kumar was going to deposit Rs. 4,40,338/- in the Bank, two unknown criminals on the point of pistol snatched the aforesaid amount from the informant.

It has been submitted by learned counsel for the petitioners that the petitioners are languishing in custody since 18.07.2019. The petitioners have got no criminal antecedent.

Patna High Court CR. MISC. No.61855 of 2019(2) dt.14-11-2019 2/2 The petitioners have falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioners. The petitioners are not named in the F.I.R. The name of the petitioners has come in the present case on the basis of confessional statement of co-accused. There is no recovery of any incriminating article from possession of the petitioners. The petitioners have not been put on T.I. Parade. On behalf of the State, it is submitted that the petitioners are not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M. Hajipur, Vaishali, in connection with Hajipur Sadar P.S. Case No. 462 of 2019.
