Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner apprehends arrest in connection with Rafiganj P.S. Case No. 278 of 2023 registered for the offences under Sections 363, 365, 369, 120B and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the instant case. Further submission is that the informant has filed a affidavit before the court below that his newly born second son was taken to Gaya for treatment by his Jija where he died and was buried in Falgu river as contained at Annexure P/2. Further, the informant has also filed a compromise petition as contained at Annexure P/3. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner, above named is directed to be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of C.J.M., Aurangabad in connection with Rafiganj P.S. Case No. 278 of 2023, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
