The petitioner has filed this civil miscellaneous petition against the order dated 25.04.2018 by which the petition of the petitioner for recalling the plaintiff's witness No.7, Suchit Kumar Singh for further cross-examination has been rejected. On perusal of the records, I find that P.W.7 has already been thoroughly cross-examined and thereafter discharged but since the plaintiff sold some piece of land after examination of P.W.7, it does not entitle the defendant to recall the witness for further cross-examination. Therefore, learned court below has rightly rejected the petition of the petitioner for recalling P.W.7. Accordingly, this civil miscellaneous petition is dismissed.
