This writ application has been filed for a direction to the respondent to consider and make payment of salary for the period the petitioner has worked. There is no need to take response of the private respondent No.5 and 6. As there is no dispute as to inter se seniority or dispute as to who shall be in charge of headmaster and head mistress in the school.

In view of relief prayed for, this writ application is disposed of with the direction to the respondent, Distinct Education Officer,

Patna High Court CWJC No.16718 of 2017 dt.22-03-2018 2/2 Muzaffarpu to take and decide the claim of the petitioner for payment of salary for the period the petitioner has worked. The petitioner admited that he has already handed overcharge to Sanju Devi and as such there is no reason to keep the payment of salary of the petitioner in abeyance. Accordingly, respondents are directed to take immediate steps for release of the salary of the petitioner and ensure payment and any order passed by the respondent for keeping the salary of the petitioner shall not come in the way in view of the fact of subsequent development whereby the petitioner was handed over charge to Smt. Sanju Devi.

In view of the above, the writ application stand disposed of accordingly.
