JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 15-02-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.

The petitioner seeks bail in a case for the offence punishable under section 304 (B)/34 of the I.P.C The accusation is that the petitioner and other coaccused killed Hemlata, the daughter of the informant, who was married to Vinay Ram, the son of the petitioner, due to non fulfillment of demand of additional dowry by way of cash and motorcycle.

Submission is of false implication and that the petitioner is mother-in-law of the deceased, she has got no concern with the family affairs of her son and his deceased wife, the petitioner is living separately, other similarly situated co-accused

Patna High Court Cr.Misc. No.52695 of 2015 (3) dt.15-02-2016 2/2 have been allowed pre-arrest bail vide Cr. Misc. No. 887 of 2016 and as such the petitioner who is suffering in custody since 03.06.2015 deserves sympathetic consideration, to which the learned A.P.P. does not oppose.

In the facts and circumstances as stated above, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. Dalsingsarai, DistrictSamastipur in Dalsingsarai P.S. Case No. 217 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
