Petitioner, already in custody, seeks bail in connection with Pirbahore P.S. Case No.177 of 2017, registered under Sections 274, 275, 276, 467, 468 and 120(B) of the Indian Penal Code as well as under Sections 18(B), 28(A), 65(A), 27(d)/18(a) (i)/27(a), 27(c) and 36(a) of the Drugs and Cosmetic Act. Allegation in brief is that some cartons of medicines were recovered from the medicine shop of the petitioner and there was no print of MRP and expiry date on it.
Learned counsel for the petitioner submits that the petitioner is a licensee for running a medicine shop, the MRP and expiry date is mentioned on the medicines and only allegation is that it was not mentioned on the cartons in which the medicines
Patna High Court Cr.Misc. No.57459 of 2017 (3) dt.17-01-2018 2 /2 were kept, petitioner is in custody since 18.06.2017 and chargesheet has been submitted in this case. Considering the facts and circumstances of the case, petitioner Ravi Shankar Prasad is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Pirbahore P.S. Case No.177 of 2017.
