JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 28-06-2022 Learned counsel for the petitioner submits that the petitioner of this case died during the pendency of this application. He has further informed that earlier this petitioner had filed an application under Section 125 Cr.P.C. seeking maintenance allowance for the applicant no. 1 who happens to be his Nati (deceased daughter's son). Over the period, the custody of the minor child (applicant no. 1) was given to the opposite party.
Learned counsel has though agitated certain issues with respect to a fresh cause of action which may have arisen to the applicant no. 1 who is not before this Court but very soon learned counsel realized that this issue cannot be taken up in present proceeding and hence he has abandoned his submission
Patna High Court CR. REV. No.621 of 2018(3) dt.28-06-2022 2/2 on that count.
So far as this case is concerned, it has lost it's significance and it is dismissed accordingly. (Rajeev Ranjan Prasad, J) vats/- U T Issue notice to the opposite party no.2 through both by ordinary process as well as under registered cover with A/D for which requisites etc. must be filed within two weeks from today, failing which this application as against the concerned opposite party shall stand dismissed without further reference to a Bench.
