ANJANA MISHRA ORAL ORDER 05-07-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Trial No. 847 of 2016 arising out of Excise Case No. 07 of 2013 registered for the offence punishable under Section 47A of the Excise Act.

Learned counsel for the petitioners submits that the present case is one of false implications and the alleged recovery of mixed spirit was neither from any property belonging to the petitioners nor from the conscious possession of the petitioners. It is further submitted that the police has not handed over the copy of the seizure list to the petitioners or any

Considering the nature of allegations made against the petitioners and also that the petitioners have no such criminal antecedent, let the petitioners, above named, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Judicial Magistrate, First Class, Saran at Chapra in connection with Trial No. 847 of 2016 arising out of Excise Case No. 07 of 2013, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
