The petitioner is languishing in custody for the offence punishable under Section 302/34 of the Indian Penal Code.
There is no eyewitness of the occurrence of murder. The petitioner is in custody since 17.08.2016. Earlier a Bench of this Court has refused the prayer for bail to the petitioner vide Annexure-2 considering the criminal antecedent of the petitioner and subsequent threat given by the petitioner. Learned counsel for the informant opposed the prayer for bail on the ground that the trial is at the verge of completion.

No.60537 of 2017 (3) dt.06-03-2018 P2/ Considering the fact that there is no substantial material against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Islampur P.S. Case No.80 of 2016, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
