JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-09-2019 The grievance of the petitioner in the present writ application is non payment of arrears of salary. The issue of payment of arrears or payment of salary requires factual enquiry.

Considering the aforesaid, the writ petition is disposed of with a direction to the University to verify the claim of the petitioner and on verification of the record, if anything is found payable to the petitioner, the University shall take steps for payment of lawful dues of the petitioner at the earliest within a period of three months from the date of receipt/production of a

In the event, the fund available with the University is not adequate to meet the expenses involved for payment, the University shall be at liberty to raise demand for allocation of additional fund from the State Government and the State Government may release additional fund if the demand is supported by utilization certificate of the earlier fund allocated by the State Government.

With the aforesaid, the writ application stands disposed of.
