JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------ 10-01-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State as also the learned counsel for the informant. The petitioner seeks bail in connection with Sessions Trial No.461 of 2016, arising out of Turkaulia P.S. Case No.833 of 2015, registered under Sections 302 and 201/34 of the Indian Penal Code, pending in the court of the 12th Additional Sessions Judge, Motihari, East Champaran.
Learned counsel appearing on behalf of the petitioner submits that earlier, the prayer for bail of the petitioner was rejected by this Court vide order dated 06.02.2017 passed in Criminal Misc. No.2444 of 2017 taking into consideration the
Patna High Court Cr.Misc. No.55247 of 2017 (2) dt.10-01-2018 2/2 materials collected by the Investigating Officer in course of investigation to the effect that the name of the petitioner has come in this case in the confessional statements of the other accused and the dead body of the deceased was recovered from the septic tank, situated outside of the house of the petitioner. The petitioner is in custody since 17.12.2015.
Learned counsel for the informant submits that, in this case, all the prosecution witnesses have been examined and the case is at the stage of the argument.
I find no fresh ground to reconsider the prayer of the petitioner for grant of bail. Accordingly, the prayer of the petitioner for grant of bail is again rejected. (Rajendra Kumar Mishra, J) P.S./- U T
