JUSTICE MOHIT KUMAR SHAH ORAL ORDER 31-08-2024 The present writ petition has been filed seeking the following relief:- "1. That this application is for Issuance of an appropriate writ(s), order(s) or direction and issuance of a writ in the nature of mandamus directing the Respondent authorities to remove the Water Tower, constructed over the land, appertaining to Khata No. 658, Plot No.-2732, area 0.51 Acre, situated at Mauza Barah, P.S.- Harnaut, District-Nalanda as well as to uproot the pipe lines, distributed through the land of the petitioner i.e. through khata no. 392, Plot No. 2743, which has been put by the authorities of

Patna High Court CWJC No.12232 of 2018(3) dt.31-08-2024 2/2 P.H.E.D., Govt. of Bihar."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to approach the District Magistrate, Nalanda at Biharsharif, for redressal of his aforesaid grievances. Liberty, so sought, is granted.

It is needless to state that in case the petitioner approaches the District Magistrate, Nalanda at Biharsharif, by filing appropriate representation, within a period of four weeks from today, the same shall be disposed off, by a reasoned and a speaking order, in accordance with law, within a period of six weeks, thereafter.

Accordingly, the writ petition stands disposed off on the aforesaid terms.
