JUSTICE SHAILENDRA SINGH ORAL ORDER 13-10-2025 The instant writ application has been filed by the petitioner under Article 226 of the Constitution of India, seeking the following relief(s):- " (i) For issuance of appropriate writ particularly in the nature of mandamus for commanding the respondent authority and passed an order in favour of petitioner for Mutation of the land bearing Mazua- Nourej, Thana No. 323, Khata No. 61, Khesra No. 22, Area 27.81 decimal.

2. Heard Mr. Ghanshyam Choudhary, learned counsel for the petitioner and Ms. Meera Singh, learned AC to GP-23 appearing for the State-Respondents.

3. The main grievance of the petitioner is that the mutation of the land pertaining to Khata No. 61 Khesra No. 22 Area- 27.81 decimal situated at Mauza- Nourej, Thana No. 323, is not being done by the concerned authorities.

It appears that petitioner initially filed a Mutation Case No. 949R27/2022-23 before the Circle Officer, Hasanpur, Samastipur, Respondent No. 6 that was rejected and then he challenged the Circle Officer's order before the Land Reforms Deputy Collector, Rosera, Samastipur by way of Mutation Case No. 154/2024-25 that was also rejected.

5. As per the provisions of Section 8(2) of Bihar Land Mutation Act, 2011 petitioner has efficacious remedy to challenge the order of Land Reforms Deputy Collector by way of a revision.

5.1. After having taken into account the aforesaid

Patna High Court CWJC No.15299 of 2025(2) dt.13-10-2025 3/3 provision as well as having taken into consideration the averments made in this writ petition, this Court does not find a case for invoking the writ jurisdiction for redressing the petitioner's grievance.

Accordingly, the instant application stands disposed of with liberty granted to the petitioner to approach the concerned Collector/Additional Collector by way of a revision to challenge the order passed by the Land Reform Deputy Collector, Rosera, Samastipur (Respondent No.4). If the petitioner avails of this liberty within the next six weeks from today, then the concerned Collector/Additional Collector shall decide the revision case on its merits and the time spent by the petitioner in pursuing this writ petition shall be excluded while computing the limitation period for the said revision.

7. In the result, with the aforesaid direction and liberty, the instant writ petition stands disposed of. (Shailendra Singh, J) maynaz/- U
