2. The petitioner is apprehending arrest in connection with Muffasil P.S. Case No. 617 of 2022 dated 16.08.2022, lodged under Sections 147, 148, 149, 341, 323, 307, 504 and 506 of the Indian Penal Code read with section 27 of the Arms Act.
3. As per the prosecution, FIR has been lodged against 16 named accused persons and 40-50 unknown persons against whom there is an allegation that they have assaulted the informant's brother due to which he sustained injury. The allegation is against one Satendra Kumar who fired by his pistol and hit the left ankle of informant's cousin brother. Further the allegation is also against one Arvind Kumar who fired and other

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that there is general and omnibus allegation against all the accused persons and there is nothing specific against the present petitioner of act or overt act. Counsel further submits that both the informant's side and petitioner's side are well known to each other. Counsel submits that there is case and counter case i.e. one case has been lodged from the informant's side bearing Muffasil P.S. Case No. 617 of 2022 and one case has been lodged from the accused person's side bearing Muffasil P.S. Case No. 618 of 2022.
5. Learned Counsel for the petitioner further submits that the criminal antecedent of the petitioner is clean. Counsel submits that other accused persons have been granted bail by the Co-ordinate Bench of this Court vide orders dated 08.08.2023 and 31.10.2023 passed in Cr. Misc. Nos.44625 of 2023 & 64919 of 2023 respectively.
6. Learned APP for the State opposes the prayer for bail of the petitioner.
7. As such, considering the aforesaid facts and

No.67681 of 2024(2) dt.14-11-2024 3/3 circumstances, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in connection with Muffasil P.S. Case No. 617 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C.
