2. The petitioner seeks regular bail in connection with Govindganj Police Station Case No. 413 of 2023, registered for the offence punishable under Sections 20(b)(ii)(b)/23(b)/29 of the N.D.P.S. Act.

3. As per prosecution, the recovery is of 19 Kg. 700 gms. of ganja.

4. Learned counsel for the petitioner submits that recovery is from co-accused Bindu Devi. The petitioner was seen fleeing away from the house of Bindu Devi. The petitioner has clean antecedent and he is on jail since 17.07.2023.

5. Learned APP has vehemently opposed the prayer for bail.

6. Considering the aforesaid fact, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge/Special Judge, East Champaran, Motihari, in connection with Govindganj Police Station Case No. 413 of 2023.

8. This is also subject to the condition that the petitioner shall mark his presence in Govindganj Police Station, District- East Champaran, Motihari on first and third Sunday of every month, failing which, his bail bonds shall be cancelled by the court below.
