The petitioner has prayed for bail in a case registered for the offence punishable under section 394 of the Indian Penal Code.

As per allegation in the FIR, Rs. 10,700/- and a mobile phone, ATM card and driving license were looted from the possession of the petitioner by four unknown miscreants on the gun point.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Petitioner is innocent and has been falsely been implicated in this case. Nothing has been recovered from conscious possession of the petitioner. He has not been put on TIP. Save and except

Similarly situated other co-accused has already been enlarged on bail vide order dated 26.09.2022 passed in Cr. Misc. No. 29503 of 2022 by different co-ordinate Bench of this Court. Petitioner is languishing in judicial custody since 16.02.2022. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 73 of 2022.
