The petitioner seeks bail in a case registered under Sections 399, 402, 386, 414, 413, 120-B of the Indian Penal Code and 25(1-B)a/26/35 of the Arms Act.

Prosecution case, in short is that on the tip off, the informant with other police personnel reached at the place of occurrence and noticed that some persons were making conversation behind the bush. Noticing the police party, they started to flee away but on chase, four persons including the petitioner were arrested.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 14-12-2018. Charge

Patna High Court CR. MISC. No.61759 of 2019(2) dt.05-11-2019 2/2 sheet has already been submitted. One country-made pistol and two live cartridges are alleged to have been recovered. There is no compliance of Section 100 of Cr.P.C.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Siwan in connection with Pachrukhi P.S. Case No. 346 of 2018.
