2. The present application has been preferred for the following relief(s):

(1.) for issuance of writ in the nature of writ of Mandamus commanding the respondent authorities especially respondents no- 4 to do the Mutation of the land/Home of the petitioner bearing Khata No-405/38 Plot no- 3924/98, Area 11⁄2 Khatha in mauza-Aurangabad as the land is in question has been partition vide suite no60/2011 by the civil court Aurangabad. (ii.) For commanding the respondents specially the respondent No- 4

Patna High Court CWJC No.14458 of 2025(3) dt.05-05-2026 2/3 to obey the order passed by the learned Deputy Commissioner Land Reforms Aurangabad in Mutation Appeal No157/2021-22 vide order dated 06-05-22. (iii.) For any other relief(s) which ever is applicable in the facts and circumstances of the case.

3. The petitioner earlier aggrieved by the order passed by the Circle Officer, Aurangabad in Mutation Appeal Case No. 157 of 2021-22 (Pradeep Kumar vs. State of Bihar).

4. It was allowed on 06.05.2022 (Annexure-1 to the petition) setting aside the order passed by the Circle Officer, Aurangabad with a direction to the concerned Officer to take a fresh decision.

5. Learned counsel for the petitioner has taken this Court to Annexure-4 to show that again by an order dated 26.02.2025, the Circle Officer, Aurangabad, for the reason best known, negated the claim of the petitioner.

6. Aggrieved, the present petition.

7. Learned State Counsel submits that if the Circle Officer, Aurangabad has passed an order, the petitioner ought to have moved before the Deputy Collector Land Reforms, Aurangabad instead of approaching Patna High Court.

8. At this juncture, learned counsel for the petitioner

Patna High Court CWJC No.14458 of 2025(3) dt.05-05-2026 3/3 submits that he shall be preferring an appropriate petition/ appeal before the DCLR, Aurangabad.

9. If such petition is preferred in next four weeks, considering that the petitioner was agitating the matter before this Court, the limitation petition has to be considered and disposed of accordingly.

10. Further, the Deputy Collector Land Reforms, Aurangabad is duty-bound to pass a reasoned order in the matter after hearing all the parties.

11. The writ petition is disposed of with aforesaid observation.
