Petitioner seeks bail in a case registered under Sections 302/34 of Indian Penal Code.
It is submitted by the petitioner's counsel that the medical evidence does not support the allegations, as stated in the first information report regarding injuries being caused by sharp cutting weapon. He further submits that there is a subsisting land dispute between the parties.
This Court has examined the case diary. It appears that the petitioner has been named in the first information report
Patna High Court Cr.Misc. No.57181 of 2017 (3) dt.02-02-2018 2/2 by the informant who had seen the petitioner assaulting the deceased. Witnesses have also supported the case of the prosecution and inquest report also shows injuries caused by sharp cutting weapon. Petitioner has also criminal antecedent. Considering the seriousness of the allegation, I am not inclined to enlarge the petitioner on bail. Prayer for bail is rejected.
