The petitioner being the husband of the informant is languishing in custody since 09.12.2015 in a case registered for the offences punishable under sections 341, 323, 436, 427 and 498A of the Indian Penal Code.

Prosecution case is of inflicting torture after 20 years of marriage. It is also alleged that the petitioner in drunken condition assaulted the informant and put the house on fire. It is submitted by learned counsel for the petitioner that the petitioner is ready to keep the informant as wife with full dignity and honour. In fact, the informant is still residing in the house of the petitioner. A statement to that effect has been made in paragraph 12 of the petition, which reads as under :-

Patna High Court Cr.Misc. No.22447 of 2016 (2) dt.19-05-2016 2/2 "12. That it is important to mention here that the informant (wife of the petitioner) is residing at the house of the petitioner and he will always keep with full dignity and respect." It is further submitted that the investigation has already concluded.

Considering the aforesaid fact, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Araria, in connection with Bousi P.S. Case No.134/2015. (Dinesh Kumar Singh, J) Ashwini/- U T
