JUSTICE JYOTI SARAN ORAL ORDER 22-06-2016 Heard Mr. Chandan Priyadarshi, learned counsel for the petitioner and Mr. Arun Kumar A.C. to G.P.5 for the State. The petitioner prays for disposal of Misc. Case No.43 of 2015 by the Joint Registrar, Cooperative Societies, Saran Division, Chapra in accordance with law.

The grievance is that the said application was filed seeking dissolution of the Managing Committee of the Awarai Primary Agriculture Credit Cooperative Societies, Saran at Chapra inter alia on grounds that it has been reduced to a minority. According Mr. Priyadarshi the application was filed under Section 41(5) of the Bihar Cooperative Societies Act before the Joint Registrar who

Patna High Court CWJC No.9473 of 2016 (2) dt.22-06-2016 2/2 referred the matter to the Registrar for appropriate directions and has been remanded to him for its disposal in accordance with law. The grievance is that the matter is being unnecessarily delayed. Since the grievance raised by the petitioner is for an expeditious disposal of the case hence instead of keeping the writ petition pending I deem it fit and proper to dispose of the writ petition with the direction to the Joint Registrar, Cooperative Societies, Saran Division at Chapra to dispose of the Misc. Case No. 43 of 2015 in accordance with law but only after opportunity of hearing to all affected parties concerned including the members who are stated to have resigned from the membership and considering the nature of the grievance raised, an expeditious disposal preferably within three months from the date of receipt/production of a copy of this order would serve the purpose.
