This is an application for bail in connection with Tajpur P.S.Case No. 6 of 2017 registered for the offences punishable under Sections 147, 148, 149, 448, 341, 323, 324, 302, 504 and 506 of the Indian Penal Code.

Allegation against the petitioner is of assault to brother of deceased causing injury to him and other accused persons have assaulted the deceased.

Submission of learned counsel for the petitioner is that there is no allegation of assaulting the deceased against the petitioner and he is in custody since 31.7.2017. Heard learned APP and learned counsel for the informant. They have opposed the prayer for bail stating that trial has already been concluded and some accused persons have already been convicted and further trial of the petitioner is going

Patna High Court Cr.Misc. No.56197 of 2017 (2) dt.23-11-2017 2/2 on and one witness has already been examined and trial will be concluded within two months and other accused persons are absconding.

Having heard both sides and considering the facts and circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Samastipur, in connection with Tajpur P.S.Case No. 6 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned, (2) Petitioner will co-operate in trial and appear on each and every date in court, except showing any genuine reason, failing which his bail bond shall be cancelled.

Trial court is directed to continue with the trial and try to conclude it as early as possible.
