JUSTICE PARTHA SARTHY ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 10-01-2025 The writ petition is filed for the removal of construction of a garbage yard in a Government Public Pond situated in Manikpur, Tola-Kasba, which is said to be constructed by the Mukhiya of the Panchayat; the 7th respondent. The Block Development Officer, Tarapur District Munger, has filed an affidavit dated 30.03.2023, wherein it is submitted that District Magistrate, Munger, has issued

Patna High Court CWJC No.15255 of 2023 dt.10-01-2025 2/2 Annexure-R-3 to R-5/A communications for the purpose of identification of land upon which the construction of a Waste Processing Unit (for brevity 'WPU') can be carried out in Manikpur in respect of the land selection upon which the WPU is intended to be constructed.

2. The Superintendent of Police also submits that on inquiry, it was found that a no-objection certificate has not been received. As of now, the WPU has not been constructed and the matter is pending before the Circle Officer.

3. We find absolutely no reason to initiate a public interest litigation at this stage. In the circumstances, the petitioner sought withdrawal of the writ petition seeking liberty to approach the Circle Officer with the above objections.

4. Liberty granted. The writ petition stands dismissed as withdrawn.
