JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 25-09-2025 Learned counsel for the petitioner is permitted to make necessary correction in para 3 of the bail petition in course of the day.
2. Heard learned senior counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State.
3. Petitioner seeks regular bail in a case registered under Sections 126(2), 115(2), 118(1), 109, 329(4), 324(4), 3(5) of B.N.S. and Section 37 of the Bihar Prohibition and Excise Act.
4. As per prosecution case, on the alleged date of occurrence, when co-accused Abhinav Singh @ Dhanji Singh

No.63248 of 2025(3) dt.25-09-2025 2/3 along with another co-accused sitting on a motorcycle was stopped from going on newly paved lane constructed under government scheme situated in front the house of informant, he abused and assaulted the informant, his father and brother with lathi causing injuries to the persons of the injured. It is further alleged that thereafter Abhinav Singh @ Dhanji Singh called three more persons on phone. They all again assaulted the informant, his brother, father and wife. Abhinav Singh @ Dhanji Singh assaulted the informant on his head whereas the person who came on motorcycle with him (petitioner) assaulted the wife of informant with iron rod causing her head injury. The accused persons are further alleged to have entered the house of informant and caused destruction of property and beaten small children.
5. Learned senior counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Only general and omnibus allegations are made against the petitioner. There is a case and counter case between both the parties. Petitioner is not named in the F.I.R. and he has been arrested when he went to lodge a formal complaint at the police station. Petitioner is alleged to have given iron blow on the head of wife of informant but the injury found on the person
Patna High Court CR. MISC. No.63248 of 2025(3) dt.25-09-2025 3/3 of the injured is 1''x1⁄2'' skin deep on forehead which is superficial wound. Petitioner has one criminal antecedent registered under Sections 353, 506 and 34 of I.P.C. in which he is on bail. Petitioner is in jail since 25.07.2025 and he undertakes to cooperate in the investigation and trial.
6. Learned counsel for the informant and learned A.P.P. vehemently opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case, submissions of the parties and period of custody, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge-2, Rohtas, Sasaram in connection with Sasaram Nagar (Rohtas) P.S.
