The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307 and 379/34 of the Indian Penal Code. The prosecutions case is that on 26.04.2016 at about 8 A.M., the accused persons including the petitioners started making construction over the land of the informant. On protest

Patna High Court Cr.Misc. No.24271 of 2016 (2) dt.31-05-2016 2/3 being made, co-accused Md. Hamid assaulted with Garasa on the head of the Haider Ali, the husband of the informant. In the meantime, both the petitioners assaulted the informant when petitioner no. 1, Asnsari Khatoon took away Rs. 30,000/- from the house of the informant.

It is submitted by learned counsel for the petitioners that the injuries inflicted on the informant's husband found to be simple in nature and the accusation has been leveled in the background of land dispute and also proceedings under Sections 144 and 107 of the Cr. P.C. pending between the parties. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners above named in the event of their arrest or surrender before the Court below within a period of twelve weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in
