The petitioners being the parents, brother, brother's wife, nephew and sisters of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code. The accusation is of killing the daughter of the informant within 13 years of marriage for non-fulfillment of dowry demand.
It is submitted by learned counsel for the petitioners that the accusation is not specific against these petitioners. There
Patna High Court Cr.Misc. No.11287 of 2015 (2) dt.28-04-2015 2/2 is no complaint with regard to dowry demand and torture in 13 years of marriage. The husband of the victim is in custody. Considering the omnibus and general accusation against the entire in-laws family, let them be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Bakhtiyarpur (Balwahat O.P.) P.S. Case No.268 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. The bail bonds of the petitioners will be accepted on filing of the affidavit by the petitioners before the learned court below to the effect that they will regularly co-operate in the investigation. Non-cooperation in the investigation by the petitioners will give liberty to the learned court below to cancel the bail bonds of the petitioners.
