1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Barachatti (Mohanpur) P.S. Case No. 426 of 2020 dated 16.07.2020 registered under Sections 379 of the I.P.C.

3. As per the first information report on 13.07.2020 the informant had parked his motorcycle in the verandah of the Ex-Mukhiya and in the next morning he found that his motorcycle was stolen.

4. Learned counsel for the petitioner submits that F.I.R. was lodged against unknown. During the course of investigation the informant himself informed the Police on the next day after lodging of the F.I.R. that the stolen motorcycle has been recovered and the person who had stolen the motorcycle was also caught. On this information the Police reached at the place

Patna High Court CR. MISC. No.67412 of 2024(2) dt.23-10-2024 2/2 of occurrence and seized the motorcycle and arrested one Sandeep Kumar Yadav. The arrested accused person has disclosed the name of the petitioner as his accomplice. The petitioner is having no criminal antecedent.

Regard being had to the submission made by the parties, taking into consideration the fact that the petitioner is having no criminal antecedent and the motorcycle was recovered by the informant himself, who informed the Police about this, I am inclined to grant anticipatory bail to the petitioner.

6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Gaya in connection with Barachatti (Mohanpur) P.S. Case No. 426 of 2020 subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Anil Kumar Sinha, J) praful/- U T
