The petitioner seeks bail in a case registered for offences under Sections 30 (A), 32(ii) and 41(i) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 225 litres of foreign liquor was recovered from the sumo and tempo. Seeing the raiding police party five boarded persons including the petitioner tried to escape but four persons were apprehended on chase by the police and one managed to escape. It is contended that petitioner has no connection with

No.55676 of 2017(2) dt.23-11-2017 2/2 the illicit liquor as he was simply apprehended for the reason that he was passing through the place of recovery and nothing has been recovered from the conscious possession of the petitioner. It is urged that the petitioner has remained in custody since 19.09.2017, i.e., for about more than two months. It is claimed that the petitioner is having clean antecedent.

Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-VIIIcum-Special Judge, Excise Act, Patna in connection with Danapur P.S. Case No. 649 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
